Terms and Conditions for HVAC Services

  1. Scope of Services.
  • The service provider agrees to perform HVAC-related services including installation, maintenance, repair, inspection, and replacement of heating, ventilation, and air conditioning systems as agreed in the service quote or work order as discussed and agreed upon with the customer.

   2. Estimates, Quotes and Pricing

  • All quotes and estimates are valid for a limited period (e.g., 7–30 days unless stated otherwise).
  • Final pricing may vary if unforeseen issues arise (e.g., hidden damage, code compliance requirements).
  • Any additional work and costs will require customer approval before proceeding.

   3. Payments

  • Payment terms will be specified in the invoice.
  • A deposit may be required for large installations or special-order equipment.
  • Late payments may incur additional fees or interest.

   4. Scheduling and Access

  • Service times are scheduled based on availability.
  • The customer must provide safe and reasonable access to the property and HVAC systems.
  • Delays caused by lack of access may result in rescheduling or additional charges.

    5. Warranties

  • Workmanship warranty: Typically 30–365 days depending on service type.
  • Manufacturer warranties apply to parts and equipment.
  • Warranty may be void if equipment is tampered with by unauthorized persons or due to customer misuse or lack of maintenance.

    6. Cancellations and Rescheduling

  • Cancellations are required at least 48 hours in advance.
  • Missed appointments or late cancellations may incur a call-out fee.

    7. Liability

  • The service provider is not liable for any pre-existing system conditions, customer misuse or unrelated property damage.
  • Liability is limited to the cost of the service provided, unless otherwise required by law.

    8. Permits and Compliance

  • Where required, permits will be obtained before commencing work.
  • All work will comply with applicable local building codes and safety regulations.

    9. Customer Responsibilities

         The customer agrees to:

  • Disclose known issues with the HVAC system or property issues
  • Ensure electrical and structural safety
  • Maintain equipment after service as recommended

    10. Force Majeure

  • The service provider is not responsible for delays or failure to perform due to events beyond reasonable control (e.g., weather events, supply chain disruptions, unforeseen emergencies).

   11. Termination

  • Either party may terminate the agreement before work begins. Costs incurred up to that point may still be charged including material costs.

   12. Governing Law

  • These terms are governed by the laws of the jurisdiction in which the service is performed (e.g., New South Wales, Australia, if applicable).

  13. Title Retention (Ownership of Materials and Equipment)

  • The customer acknowledges that installation does not transfer ownership until full payment is made for all labour, material, equipment and part costs.
  • All materials, parts, equipment, and installed systems supplied by the service provider remain the property of the service provider until full payment has been received and cleared in accordance with the agreed payment terms.
  • If the project is completed and payment is not received within a reasonable period (e.g., 7–14 days unless otherwise specified on the invoice), the service provider reserves the right to:
  • Retain ownership of all supplied materials and installed equipment
  • Remove or recover installed equipment where legally permitted
  • Suspend or revoke any warranties or ongoing service obligations
  • Take further recovery action, including debt collection or legal proceedings

   14. Acceptance of Terms and Conditions

  • By requesting, scheduling, or confirming any work (including verbal approval, written acceptance, email confirmation, text message approval, or acceptance of a quote), the customer acknowledges that they have read, understood, and agreed to be bound by these Terms and Conditions.
  • Commencement of work by the service provider constitutes acceptance of these Terms and Conditions by the customer. No additional signature is required for these terms to be legally binding, unless otherwise stated in writing.
